By accessing or using the Kreavo AI creative visual tool (the "Service"), including but not limited to image stylization, AI dance, face swap, outfit change, and image-to-video generation features, you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you ("User" or "you") and Kreavo. The Service is provided for personal, non-commercial use unless otherwise expressly authorized by us. 2. Eligibility By using the Service, you represent and warrant that: You are at least 18 years of age, or the age of legal majority in your jurisdiction. You have the full power and authority to enter into these Terms. You are not located in a country that is subject to a U.S. government embargo or that has been designated by the U.S. government as a "terrorist-supporting" country. You are not listed on any U.S. government list of prohibited or restricted parties. If you are using the Service on behalf of a legal entity, you represent that you have the authority to bind that entity to these Terms. 3. Account Registration To access certain features of the Service, you may need to create an account. You agree to: Provide accurate, current, and complete registration information. Your User Content does not infringe upon any third-party intellectual property rights, privacy rights, or other legal rights. Your User Content complies with all applicable laws and these Terms. 4.3 Data Processing By using the Service, you acknowledge that Kreavo may process your User Content using artificial intelligence algorithms to generate outputs. This processing may involve automated analysis and transformation of your content. 5. Prohibited Use You agree not to use the Service for any unlawful or prohibited purpose, including but not limited to: Illegal Activities: Using the Service to create, distribute, or promote illegal content or activities. Harmful Content: Generating content that is defamatory, harassing, threatening, obscene, or otherwise objectionable. Misrepresentation: Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity. Deepfakes and Deception: Using the Service to create deceptive or misleading content, including deepfakes, without appropriate disclosure or consent. Exploitation: Creating content that exploits, harms, or attempts to exploit or harm minors in any way. Violation of Rights: Infringing upon the intellectual property, privacy, or publicity rights of others. Automated Access: Using bots, scrapers, or other automated methods to access or use the Service without our express written permission. Reverse Engineering: Attempting to decompile, reverse engineer, or disassemble the Service or its underlying technology. 6. Intellectual Property 6.1 Service Ownership The Service, including its software, algorithms, user interface, design, trademarks, and all related intellectual property, is owned by Kreavo or its licensors. Except for the limited license granted herein, no other rights are granted to you. 6.2 Output Ownership The output generated by the Service ("Output") is owned by Kreavo, subject to your rights under applicable law. You may use Output for personal, non-commercial purposes. Commercial use of Output is prohibited without prior written consent from Kreavo. 6.3 Feedback If you provide feedback or suggestions regarding the Service, you grant Kreavo a perpetual, irrevocable, royalty-free license to use such feedback for any purpose without compensation to you. 7. Privacy Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and sharing of your information as described in the Privacy Policy. Key privacy considerations for AI tools: We process User Content to generate Output and improve our algorithms. We may collect metadata about your usage patterns. We implement reasonable security measures to protect your data, but cannot guarantee absolute security. 8. Disclaimers THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, KREAVO DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR QUALITY OF OUTPUT GENERATED BY THE SERVICE. We do not guarantee that the Output will meet your expectations or that it will be free from errors, biases, or unintended consequences inherent in AI systems. 9. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KREAVO, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, DATA, USE, OR GOODWILL. PERSONAL INJURY OR PROPERTY DAMAGE. ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100). 10. Termination We reserve the right to suspend or terminate your access to the Service at any time, without notice, for any reason, including if we believe you have violated these Terms. Upon termination: Your right to use the Service will immediately cease. We may delete or deactivate your account and all related data. Sections 4, 5, 6, 8, 9, 11, and 14 shall survive termination. You may terminate these Terms at any time by discontinuing use of the Service and deleting your account. 11. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved exclusively in the state or federal courts located in San Francisco County, California. 12. You acknowledge and agree that: Output Variability: AI-generated outputs may vary in quality, accuracy, and appropriateness. We do not guarantee specific results. Bias and Fairness: AI models may contain inherent biases. We strive to minimize harmful biases but cannot guarantee complete fairness. Transparency: You should clearly disclose to viewers when content has been generated or modified using AI. 14.2 Image Stylization The style transfer process may alter original images in unpredictable ways. You are responsible for ensuring you have the right to stylize any images you upload. 14.3 AI Dance Feature This feature generates animated dance movements based on input images. Outputs should not be used to create deceptive or misleading content about real individuals' abilities or actions. You must obtain consent from any identifiable individuals in the input images before using this feature. 14.4 Face Swap and Outfit Change These features involve modifying images of people. You must: Obtain explicit consent from all individuals depicted in the images. Not use these features to create non-consensual intimate images, harass, deceive, or defraud others. Comply with all applicable laws regarding image manipulation and privacy. We reserve the right to implement additional verification or consent mechanisms. 14.5 Image-to-Video Generation This feature creates video content from still images. Generated videos may contain artifacts, inconsistencies, or unintended content. You are responsible for ensuring that generated videos comply with all applicable laws and platform policies. 14.6 Data Retention We may retain your User Content and Output for a reasonable period to improve our algorithms and provide ongoing service.
